It can take about six months for the tribunal hearing to be arranged. Hi I telephoned ESA office again yesterday and was told I would receive a call back within 3 hours, that never materialised. They now say they do not know where their information has come from as it does not match that of HMRC, so they need to investigate.
They have refused to send HMRC something called a Benefit involved file, which HMRC National insurance contributions office asked them to send to them, they claim it is not applicable in my case. Funny that as it will prove that they have got the wrong information. They have failed to pass on a copy of my National insurance contributions record to the benefits office ,which I was sent by HMRC, this would show that I had Class 1 national insurance credits for the relevant years that they needed, to and to Now they are claiming that half of the credits are missing for those years, which they are not.
I am at my wits end.!! I will now write to the complaints department as it is not a joke any more. Anyone any better ideas??? The Job Centre has sent several emails to the ESA Department and my daughter managed to get through via the telephone this morning after trying several times. Will she be entitled to backdated payments since the ESA was stopped in December ? And will she be transferred back on to the old style Incapacity Benefit before it was changed to ESA?

Four years ago I was denied PIP due to a mix-up over rescheduling an assessment but after asking for an MR never heard anything until, months later I was able to get through on the phone to ask about progress, only to be told the decision had been upheld.
Even my MP was unable to obtain a copy. I was unwell on top of usual conditions and the added stress and confusion made me far worse.
It took until late last year before I could reapply only now to have phone assessment. Bear in mind that the DWP had to be taken to court in order to achieve this outcome.
